1. Introduction
Welcome to GentleBrookWay ("us," "we," or "our"). These Terms & Conditions ("Terms") are a contract between you and GentleBrookWay and apply to your use of our yacht rental services and our website found at gentlebrookway.site (our "Service"), which is managed by GentleBrookWay.
Committing to a reservation or using our Service constitutes your acceptance of these Terms. Should you object to any portion of these terms, you are not permitted to use the Service.
2. Service Overview
GentleBrookWay offers a variety of upscale yacht charter services including, but not limited to:
- Yacht hire for the day
- Evening yacht tours
- Business outings
- Exclusive celebrations
- Extended yacht voyages
All services depend on their availability and suitable climate conditions. We hold the power to adjust or cease services as needed.
3. Booking and Reservations
3.1 Booking Process
Criteria for booking a yacht include:
- Being 18 years of age or more
- Furnishing precise and thorough details
- Making an initial deposit as indicated in your reservation confirmation
- Consenting to these Terms & Conditions
3.2 Reservation Confirmation
We confirm your reservation once we have received payment along with our written verification. We have the authority to decline service to anyone at our own discretion.
3.3 Charter Availability
All yacht bookings are subject to the vessel's availability and fitting weather conditions. We strive to accommodate your preferred scheduling to the best of our ability.
4. Payment Terms
4.1 Costs
All rates are quoted in € and cover the applicable taxes unless stated otherwise. Rates are subject to modifications without prior notice.
4.2 Payment Plan
- Advance Payment: 50% of the overall charter cost is due at the time of booking
- Remaining Balance: To be paid 48 hours prior to the departure of the charter
- Extra fees (if applicable): Due after the charter service is provided
4.3 Accepted Payment Forms
We accept major credit cards, electronic funds transfer, and certified cheques. Payments are processed using safe, encrypted methods.
5. Cancellation and Refund Policy
5.1 Client Cancellations
- Over 72 hours before departure: Complete refund minus transaction fees
- Between 24 to 72 hours before departure: Half of the amount is refundable
- Under 24 hours prior to departure: Non-refundable
5.2 Cancellations Due to Weather
If our captain determines that weather conditions are unsafe, we propose to:
- Reschedule your charter to another accessible date with no additional charge
- Issue a full refund if rescheduling is not feasible
5.3 Mechanical Failures
In case of mechanical issues with the designated vessel, we will try to arrange a suitable substitute. If this is not possible, we will issue a complete refund.
6. Safety and Behaviour
6.1 Safety Protocols
All occupants must:
- Adhere to all instructions from the crew
- Utilize safety equipment as necessary
- Disclose any health conditions that may influence their safety
- Stay within the designated areas of the craft
6.2 Restricted Items
Passengers are not permitted to bring aboard:
- Containers made of glass
- Unlawful substances
- Guns or other weapons
- Excessively intoxicating substances (beyond reasonable consumption)
- Animals (unless pre-authorized)
6.3 Conduct Rules
Travelers are obliged to behave respectfully. A charter can be ended prematurely without compensation if the conduct of any passenger poses a risk to safety or interferes with the pleasure of others.
7. Liability and Insurance
7.1 Our Responsibility
We only accept liability up to the fee paid for your yacht reservation. We are not accountable for:
- Individual injuries caused by the negligence of passengers
- Destruction or theft of personal belongings
- Indirect, resultant, or punitive damages
- Delays resulting from weather or incidences outside our control
7.2 Insurance Policies
Our operation includes broad marine insurance which covers our fleet and activities. Passengers are responsible for obtaining their own personal and travel insurance.
7.3 Assumption of Risk
Participating in our yacht chartering signifies that you recognize the intrinsic dangers of sea-based activities and you take on personal responsibility for your safety and security.
8. Adjustments and Itinerary Alternations
We have the prerogative to alter itineraries, navigation paths, or schedules based on meteorological conditions, safety reasons, or operative necessary changes. We will endeavor to ensure alternate experiences of equivalent standard.
9. Force Majeure
We are not accountable for postponements, cancellations, or alterations brought on by events beyond our control, including but not confined to:
- Adverse weather patterns
- Natural calamities
- Regulatory commands
- Terminal shutdowns
- Vehicular malfunctions
10. Data Protection and Privacy
Your personal data is managed as per our Privacy Policy. Utilizing our services grants your approval to the collection and use of your data as delineated in our Privacy Policy.
11. Intellectual Ownership
The content on our website, such as text, graphics, logos, and pictures, is safeguarded by copyright and trademark laws. You may not duplicate, disseminate, or produce derivative content without our explicit consent.
12. Governing Regulations
The applicable Monaco laws govern these Terms. Any conflicts will be settled in courts situated in Monte Carlo, Monaco.
13. Alterations to Terms
We hold the right to change these Terms as necessary. Any revisions will be communicated on our website along with the revision's effective date. Using our services post any changes signifies your agreement to the amended terms.
